ACCESS RESTRICTIONS AND DISCLAIMER OF LIABILITY

This database site is known as 'eTRACE' (“the Site”). It is owned and operated by Arjo AB (Registered Co. No. 559092-8064) (Including all its subsidiary companies) with registered office at Box 8861, 402 72 Gothenburg, Sweden (“Arjo”). This site is for access and use only by employees of Arjo and other authorised licensees on a restricted basis subject to the following terms and conditions of use:-

1. Access

   1.1

   Access is subject to password control and the Site shall only be accessible to password holders.

   1.2

   Arjo reserves the right in its sole discretion to deny access to the Site or any part of the Site to any unauthorised users without notice and to decline to provide services or facilities to any unauthorised user or to any other user who is in breach of these terms and conditions of use.

   1.3

   If you are not an Arjo employee and are not otherwise an authorised user/licensee, access to the Site is denied to you. DO NOT USE THIS SITE.

2. Confidentiality

   All users shall treat the data and other information stored on the Site as strictly confidential and shall not divulge the whole or any part thereof to any other party except as required by law. Disclosure to fellow employees and to professional advisors of Arjo is permitted, but only on the basis that they are bound by similar obligations of confidentiality.

3. Intellectual Property

   All data and other information stored on the Site and all intellectual property rights (including in particular copyright) relating to such data/information, are and shall remain the property of Arjo. No reproduction of the data/information is permitted other than with Arjo’s written consent and in accordance with these terms and conditions.

4. Contents

   4.1

   No responsibility is assumed by Arjo for the data/information stored on the Site or for any loss that may arise as a result of relying on such data/information and all liability is disclaimed in respect of such data/information to the fullest extent allowed by law.

   4.2

   Arjo is providing the Site and the data and other information stored thereon on an “as is” basis and makes no representations or warranties of any kind with respect to the Site or its contents and disclaims all such representations and warranties. In addition, Arjo makes no representations or warranties about the accuracy, or completeness or suitability for any purpose of the data or other information, or related graphics published on the Site. The data and other information contained on the Site may contain technical inaccuracies or typographical errors. All liability of Arjo, howsoever arising, for any such inaccuracies or errors, is expressly excluded to the fullest extent permitted by law.

   Neither Arjo nor any of its directors, employees or other representatives will be liable for loss or damage arising out of or in connection with the use of the Site. This is a comprehensive limitation of liability which applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damaged property and claims of third parties.

   Notwithstanding the foregoing, none of the exclusions and limitations in this clause 4 are intended to limit any rights that a user may have as a consumer under local or other statutory rights which may not be excluded nor in any way to exclude or limit Arjo’s liability for death or personal injury resulting from Arjo’s negligence or that of Arjo’s employees or agents.

5. Use of Information Stored on the Site

   5.1

   The user may only access and use the data and other information stored on the Site for the internal purposes of Arjo and/or for purposes of internal research and the user shall not distribute or sell [or redistribute or resell] the data or other information stored on the Site without the prior written consent of Arjo.

   5.2

   The user hereby acknowledges that the way in which he or she interprets or uses the data or other information is dependent upon the exercise of his or her own skill and judgement.

6. Security Measures

   The internet is not a secure medium and although Arjo has put in place various security procedures referred to in these terms and conditions of use, which include but are not limited to [firewalls, browser certification technology, limited access, the use of passwords, encryption, etc. as appropriate], all of which cover the storage, access and disclosure of data and information, your attention is drawn to the provisions of clause 4 of these terms and conditions of use to the effect that no responsibility is assumed by Arjo and no representations or warranties of any kind and no liabilities are accepted for loss or damage as a result of breaches of confidentiality or of security affecting any of the data (including personal data) or other information stored on the Site.
